Booking Terms

1. Agreement

  1. The Harrington Mediation Centre (Venue) aims to provide a positive, secure and professional environment for the resolution of disputes, training sessions and meetings, and may accept bookings for these purposes (Bookings).
  2. These Terms set out the agreement between Harrington Mediation Centre Pty Ltd ACN 683 696 371 as operator of the Venue, the person who places a Booking (Hirer) and each user of the venue associated with that Booking (User).
  3. By confirming a Booking, the Hirer agrees to:
    1. comply with these Terms; and
    2. ensure that each User is aware of, and agrees to comply with, these Terms.
  4. By attending a Booking, each User is bound by and agrees to comply with these Terms.

2. Inquiries, Bookings, Fees, Charges and Cancellations

  1. Inquiries about Bookings can be made online (at www.harringtonmediationcentre.com.au), by phone (+61 2 7241 4353) or by email (admin@harringtonmediationcentre.com.au).
  2. Bookings must be confirmed at least 10 working days before the first day of the Booking. Bookings are confirmed by the Hirer paying the Base Fee in full. If the Venue accepts a Booking less than 10 working days before the first day of the Booking, the Base Fee is payable immediately.
  3. Fees and Charges are set out in the attached schedule.
  4. Any Charges incurred as a result of the Booking, whether before, during or after the Booking, must be paid by the Hirer within 7 days of receipt of a valid tax invoice.
  5. The Hirer is responsible for any contribution to be made to Fees and Charges by any User.
  6. The Hirer may cancel the Booking at any time. In the event of a cancellation no less than 5 working days before the first day of the Booking, the Venue will refund 50% of the Fees paid. In the event of a cancellation less than 5 working days before the first day of the Booking, the Hirer forfeits all Fees paid.
  7. The Venue may cancel any Booking for any reason on no less than 5 workingdays’ notice, in which case it will refund all Fees paid.
  8. The Venue may cancel any Booking at any time due to unforeseen events out of its control which mean the Venue cannot reasonably or safely be used for the Booking, in which case it will refund all Fees paid.

3. Conduct during Bookings

  1. Each User agrees that they will behave in a respectful manner towards all other persons at or around the Venue, including other Users, employees, contractors or visitors, and will be considerate of their own safety and the safety of others.
  2. Any User who does not comply with clause 3a may be temporarily or permanently excluded from the Venue at its discretion.

4. Privacy

The Venue holds the Hirer’s and each User’s personal information in accordance with its privacy policy, and which may be updated from time to time on 30 days’ notice on the website.

5. Liability

  1. The Venue carries public liability insurance, but the Hirer and each User is responsible for maintaining their own workers compensation insurance and professional indemnity insurance (unless the User is a Resident Practitioner).
  2. To the extent permitted by law, the Hirer and each User releases the Venue, itsassociated entities, and any of their officers, employees, contractors and agents from any claim, demand, suit, cause of action, loss or liability of any nature or description arising from or in connection with the Hirer’s or User’s use of the venue.
  3. The Hirer is liable to the Venue for any loss of or damage to (including for cleaning) any furniture, fixtures, fittings or structures within the Venue.

6. Miscellaneous

  1. These Terms embody the entire understanding and agreement between the parties as to their subject matter. All previous negotiations, understandings, representations, warranties, documents or commitments in relation to, or in any way affecting, the subject matter of these Terms are merged in and superseded by these Terms.
  2. These Terms are governed by and must be construed in accordance with the laws of New South Wales. The Hirer and each User irrevocably and unconditionally submits to the non- exclusive jurisdiction of the courts of New South Wales and all courts that have jurisdiction to hear appeals from those courts and waives any right to object to proceedings being brought in these courts for any reason.
  3. The Hirer and each User agrees to be jointly and severally liable for any liability arising under these Terms or in connection with the Booking.

Schedule

1.         Base Fee

$1,200 + GST per day (covers use from 9 am to 6 pm)

$600 + GST per half day (covers use in any five hour period between 9 am and 6 pm)

2.         Before and After Hours Charge

$190 + GST for each hour or part thereof before 9 am and after 6 pm

3.         Third Party Disbursement Charges

At cost e.g. catering or printing.
